TERMS AND CONDITIONS FOR IN-STORE PURCHASES

  1. We at Matter Brothers Furniture thank you for your recent purchase, which we are sure, will give you years of enjoyment and pleasure.
  2. Clerical and Special-Order pricing errors are subject to correction.
  3. Prices quoted do not include delivery fee, special crating, unusual deliveries, deliveries out of our normal delivery area or prices charged by common carrier for special deliveries.
  4. All orders require the full balance paid prior to being scheduled for delivery, unless using pre-approved financing through Matter Brothers Furniture approved finance partner.
  5. Most items have a Manufactures (MFG) Warrantee. Matter Brothers will facilitate the service within the terms of the MFG warrantee. The MFG determines, at their sole discretion, an action to be taken. All Closeouts and Showroom Samples are sold “AS IS”. Service may be available at an additional fee.
  6. Warranties are extended to the original purchaser and delivery address with proof of purchase. THIS WARRANTY DOES NOT COVER NORMAL WEAR, OR ANY DAMAGE DUE TO ABUSE, NEGLIGENCE, and COMMERCIAL USE OR MISUSES ON THE PART OF THE CONSUMER.
  7. MATTRESS RETURN POLICY _ADJUSTABLE BASES. There are no returns or refunds on motion bases. All service is done through the manufacturer. You will find the 800 number to call for service and the serial number for the motion base in your Owner's Manual or on the back of your remote control.
  8. 90 DAY MATTRESS COMFORT GUARANTEE. Tempur-Pedic and Stearns & Foster Mattresses Only! We do our best to match you with the prefect mattress & foundation for the best night's sleep. You should sleep on your new mattress for a minimum of 30 nights to allow your body to adjust. If after this 30 night adjustment period you are unhappy with your mattress you may exchange mattress for one of an equal or greater value. There is a $199 re-selection fee. The 90 Day Comfort Guarantee is only valid on the original Tempur-Pedic and Stearns & Foster mattress purchase. Foundations and adjustable bases are not applicable to this program.
  9. Any returns are subject to approval by management. Upon approval they are subject to a minimum thirty percent (30%) restocking.
  10. All returns will be for merchandise credit unless previously arranged to the contrary in writing.
  11. Credit Memos are valid for one (1) year from date of issuance.
  12. Furniture deliveries may be subject to delays caused by strikes, material shortages, and transportation, etc. The delivery time quoted is the best estimate of the salesperson writing your order. We will do everything in our power to meet that date and expedite all orders if delayed for any reason. However, late deliveries will not be considered just cause for cancellation.
  13. All “not at home deliveries” will be subject to a $25.00 rescheduling fee. Matter Brothers Furniture will redeliver the same merchandise on the next available delivery date.
  14. Orders not paid in full and not accepted for delivery within 60 days of notification will be voided and the deposit forfeited unless previously arranged to the contrary in writing.
  15. All orders not delivered within two weeks of the original date of purchase are considered lay-away orders. All lay-away(s) must be paid within ninety (90) days of purchase and all special orders must be paid in full and delivered within sixty (60) days of receipt from the manufacturer unless prior arrangements have been made in writing. Orders not paid in full and not accepted for delivery within sixty (60) days of notification will be voided and the deposit forfeited unless previously arranged to the contrary in writing.
  16. All CLOSEOUT and/or AS-IS sales are final, and must be paid in full, picked up or accepted for delivery within fourteen (14) days. Anything to the contrary will be voided and the deposit forfeited unless otherwise arranged in writing.
  17. In the event it becomes necessary to initiate a lawsuit to collect monies owed, the purchaser agrees to pay all costs of collection, including reasonable attorney fees, court costs, and interest at the rate of 18% per annum.
  18. Your rights and obligations under this contract are not dependent upon method of payment, whether cash, check, credit card, or any other method of payment.
  19. Because all special-order goods are assignable to specific orders, deposits are not refundable.

TERMS AND CONDITIONS FOR ONLINE PURCHASES

We may modify these Terms and Conditions from time to time. Changes become effective when they are posted to the Site. Your continued use of the Site or the Services after such posting will constitute acceptance of the revised terms and conditions by you. If, at any time, you do not agree to be bound by the Terms and Conditions herein, do not continue to use the Site or Services.

Use of Website

  1. As a condition of your use of the Site, you agree to use this Site in a manner that is lawful and proper. You warrant that you will not use the Site for any purpose that is unlawful or prohibited by these terms and conditions. You may not use the Site in any way that could damage or impair the Site or interfere with others use and enjoyment of the Site.
  2. You agree to report to us promptly any violation of these Terms and Conditions.
  3. You agree that you have read and understood our Privacy Policy.

Products and Services

  1. Matter Brothers Furniture requires full payment of any order, including any taxes and delivery fees, at the time of sale. Matter Brothers Furniture accepts all major credit cards including Visa, Master Card, American Express, and Discover. Matter Brothers Furniture cannot accept gift cards, checks, or money orders for online purchases. These forms of payment are accepted at any of our showrooms. Financing is currently only available at our showroom locations.
  2. Charges authorized to your credit card at the time of sale will be processed immediately.
  3. Orders may be cancelled within two business days of placement. To cancel an order, contact your sales associate within two business days of placing your order. In the event of a cancellation, Matter Brothers Furniture will refund the price that you paid for the item to the credit or debit card used to make payment. Cancellations of orders after two business days may not be possible and may be subject to additional fees.
  4. Special Order items are non-cancellable and non-refundable. For more information about special order items please contact customer care.
  5. From time to time, at its sole discretion, Matter Brothers Furniture may offer special promotions, credits, awards, or discounts. All Promotions can be modified or terminated at any time by Matter Brothers Furniture with or without advance notice. Promotions may be offered on a limited time basis and may be subject to restrictions, terms, and conditions.

Delivery

Your customer service representative will call to set up a delivery date based on whether product is in stock or needs to be ordered. If items are in stock orders can be set within 2 – 5 business days of order being placed. If item is not in stock, your customer service representative will quote a delivery time and set an estimated date for delivery.

Customer Pickup

Customers pickup is available at Matter Brothers Furniture's Ft Myers Distribution Center, the Sarasota showroom, Naples showroom, and our Furniture Outlet by MB in Pinellas Park. Hours for customer pickup vary by location.

Returns

If you are not fully satisfied with your purchase, contact your customer service representative immediately. Stocking furniture may be returned within seven (7) days of date of delivery with a 30% restocking fee. The remaining balance will be issued as an in-store credit. Delivery fees are non-refundable if the service has been attempted or performed.

Warranties

We offer a one-year, from the date of delivery, in home service at no charge. After one year, a service fee applies to in-home service calls. We do not warranty any products we sell as we do not manufacture the items. We will facilitate a warrantee on behalf of the manufacturer. Our service techs will perform in-home service for touch-up, repair, and/or replacement of parts. In some cases, items may need to be removed from the home and service performed in our shop. Items may not be exchanged or returned that are deemed to be within the manufacturer's specifications.

  1. Damage at Time of Delivery: Products that are damaged at the time of delivery should be documented with the driver and our customer care department will follow up within 24 hours.
  2. Manufacturing Defects
  3. Many products sold on the Site include a manufacturer's warranty. Customers should contact customer care for assistance with manufacturing defects. Any manufacturer's warranty will be limited to the terms of the manufacturer's warranty policy.
  4. Matter Brothers Furniture offers a service warranty for one year on parts and labor for repair of defective products. Matter Brothers Furniture's warranty does not apply to damage caused by normal wear, accident, abrasion, misuse, alteration, abuse, or improper care. User Information and Surveys

  1. All information submitted to the Site by Users, including but not limited to cookies, account information, and testimonials is governed by our Privacy Policy. You can view the Privacy Policy here.
  2. Users who purchase products on the Site may receive a survey after their purchase is completed. Matter Brothers Furniture strives to provide an excellent user experience and greatly appreciates your feedback. In addition to improving our services and user experience, we reserve the right to use any testimonials, statements, or feedback for promotional purposes. By returning the survey to us, you agree that Matter Brothers Furniture may use information provided in your survey responses for promotional purposes, including but not limited to display on the Site.

Account Security

If you elect to create an account with the Site, it is your exclusive obligation to maintain and control passwords and other login information to your account. You are prohibited from sharing this information with any third party or allowing any third party to use your account. You are exclusively responsible for all activities that occur in connection with your username and password. You agree to immediately notify Matter Brothers Furniture of any unauthorized uses of your username and password or any other breaches of security. Matter Brothers Furniture will not be liable for any loss or damages of any kind, under any legal theory, caused by your failure to comply with the foregoing security obligations or caused by any person to whom you grant access to your account.

Third Party Links to Site

This Site provides links to other websites, such as mapping sites or manufacturer's sites, by allowing you to leave this Site to access third-party material or by bringing third-party material into this Site via "inverse" hyperlinks and framing technology (a "linked site"). Matter Brothers Furniture has no control over the content on a linked site. The fact that Matter Brothers Furniture has provided a link to a Site is not an endorsement, authorization, sponsorship, or affiliation with respect to such Site, its owners, or its providers. General Information

Florida law governs these Terms and Conditions, as well as any claim, cause of action or dispute that might arise between you and Matter Brothers Furniture, without regard to conflict of law provisions. For any such claim, cause of action or dispute, you agree and consent to the jurisdiction and venue of the state and federal courts of the State of Florida.
  2. If any provision of these Terms and Conditions is held unenforceable, then such provision will be modified to reflect the parties' intention, and all remaining provisions of these Terms and Conditions shall remain in full force and effect.
